REACH update: European Union further restricts the use of silicones D5 and D6 in cosmetic products

This measure is necessary to address the environmental risks associated with the use of these substances in consumer products that are ultimately released into the water system and the atmosphere. Moreover, ECHA's Risk Assessment Committee (RAC) identified cosmetic products as the main source of emissions of these substances into the environment.

It is important to remember that D4 is listed in Annex II of the EU Cosmetics Regulation – the list of substances prohibited for use in cosmetics. Therefore, the new REACH restrictions for this substance will not affect cosmetic products as its use is already prohibited.

New restrictions for D5 and D6

According to the updated REACH restrictions, decamethylcyclopentasiloxane (D5) and dodecamethylcyclohexasiloxane (D6) can be used in cosmetics under the following conditions.

Decamethylcyclopentasiloxane (D5):

  • Up to a maximum concentration of 0.1% in rinse-off cosmetic products since January 31, 2020 (already applicable);

  • Up to a maximum concentration of 0.1% in leave-on cosmetic products from June 6, 2027.

Dodecamethylcyclohexasiloxane (D6):

  • Up to a maximum concentration of 0.1% in rinse-off and leave-on cosmetic products from June 6, 2027.

According to the European Commission's view, a 3-year transition period for the new restrictions is appropriate to balance two needs. On one hand, the need to limit emissions in time. On the other hand, the necessity to give the industry enough time to meet the new requirements.

As a manufacturer or brand owner of cosmetic products, you must verify if your products contain D5 or D6. If so, you must verify if they meet the 0.1% concentration limit or otherwise proceed with reformulation, retesting, and re-notification to the CPNP. Additionally, you must ensure that non-compliant products are off the EU market by June 6, 2027.
